FAQs

The new corporate tax law will levy corporate income tax on business profits made by UAE businesses, over the course of a tax accounting period.  The UAE has introduced the lowest corporate income tax percentage within the GCC countries at a standard rate of 9%.

The corporate tax law consists of a tier system with 3 different rates:

  • All annual taxable profits that fall under AED 375,000 shall be subject to zero rate.
  • All annual taxable profits above AED 375,000 shall be subject to a 9% rate.
  • ALL MNEs that fall under the scope of Pillar 2 of the BEPS 2.0 framework (i.e. consolidated global revenues in excess of AED 3.15 billion) shall be subject to different rates as per OECD Base Erosion and Profit-Sharing rules.

Taxpayers who disagree with a decision made by the Federal Tax Authority (FTA),  can request for a reconsideration. The request must be in Arabic and submitted by the person concerned or his legal representative within 45 days of the FTA’s decision. FTA will review the request for reconsideration within 45 business days and inform the applicant of its decision within 5 business days of issuing it. If FTA does not issue a verdict within the specified time, or the applicant disagrees with the decision, the applicant can resort to ‘Tax Disputes Resolution Committee’ of Ministry of Justice (MoJ). The Committee of MoJ will study the objection and give both parties a chance to provide their feedback. It will issue its verdict within 20 business days of receiving the request. If needed, the Committee can extend this by 20 business days. Before going to the Reconsideration committee, the applicant must pay all taxes and penalties as required by the Federal Decree by Law No. 28 of 2022 Concerning Tax Procedures. Both the applicant and FTA can appeal MoJ’s committee decision in the court according to the applicable regulations.

The court of the UAE will impose tax evasion penalties against any entity or person proven guilty of evading tax. Any person who is guilty of tax evasion will get the tax evasion penalty according to Federal Law no 7 on tax procedures or any other tax law. For instance, if the person fails to fulfill the requirement for VAT, he will be penalized a certain amount for negligence or tax evasion. Tax evasion penalties consist of a prison sentence and a monetary penalty. This tax evasion penalty does not exceed five times the amount of evaded tax. If those entities that try to avoid tax evasion penalties try to consult with the tax experts for tax compliance. The average jail time for tax evasion in UAE is 7 years and it can exceed the penalty of a certain amount for bigger money laundering or tax fraud.

When conducting a tax audit, the FTA will inspect the tax returns as well as other documents and information that are part of the tax returns. It is not necessary for the FTA to have a particular reason for auditing a taxable entity. A tax audit can be conducted by the FTA in the UAE at any time or for any reason. It is nevertheless a requirement of Article 17 of the Tax Procedures Law that the FTA will notify the company at least five days before the date of the audit. Thus, the taxable entity should be prepared accordingly to provide all necessary documents and comply with the FTA in all corresponding matters.
